OK I have a little problem. On Oct 1st after seeing a sethyac show in plattsburgh. I woke up the next morning and was planning on driving to PA to see pearl jam.  anyways I was stopped at a boarder checkpoint about 100 miles from the Canadian boarder anyways it turned out that I was still a little drunk from the nite before so I was arrested for a DWI.  Now I had always thought that once you went to court they took your license for a period of 90 days or something absurd like that.  The point is I went to court twice, had to waste my gas and missed some classes during hte semester, but the judge never took my license.  NOw I must remind you this was my first alochol related and pot possion (they found a pipe in a duffle bag), which they went searching though after I told them I didnt have any pot on me, because I didnt think I did. They  must of assumed I was lying b/c I drive an 1984 VW Bus.  So this is in October.  Nothing happened with it and I was assinged one lawyer than another and now it is May and has been 7 months since my dwi and now I have to suffer all summer and not be able to drive unless it is to work, luckily I am a security at SPAC, so I\'ll get to see some good shows, but I wont be able to see any breakfast, and its bullshit

well im sure none of you guys read all that. anyways what I wondered what you guys thought about the problems with my case, and if I can get out of it without them taking my license since they should have taken it before.

I have no clue what the law is but that sucks.....sorry to hear about that.  You\'ll have it back before you know it tho.

I have a friend that recently went through the drunk driving saga.  She went to court twice, the first time was to plead her case and request accelerated rehab, the second was to be convicted and get her AR assignment.  She got a 15 week AR, license suspended for 90 days (except for work), and from what I understand, she got off w/ the absolute minimum.  The only way to really "get off scott free", would be to have a lawyer review your case to see if the pigs made any mistakes.  The whole process really sucked.

Not sure what the NY laws are, but in CT they don\'t take your license until after court appearance(s) and the suspension length is determined, and even after that they give you another week or two before its technically suspended. And I am pretty sure its the DMV who sends you the suspension notice and requires you to turn it into them.

I don\'t know for sure I haven\'t had one, but my brother is on #2 and that\'s what has happened to him in the past, this time around he lost it for a year with no work permit (kinda funny since some of his job has driving duties), first time was I think 120 days and they gave him a work permit.

Edit: And the first time he had to do like 50 hours of AA, and this time he has 200 hours community service and on probation for 2 years (not just driving, if he gets arrested/in trouble for anything I am pretty sure its mandatory jail time).

actually i have a plea offer to plead guilty to duai
but i dont know if I take it to trial what will happen and if it will be worse or if i cant get off on a technicality because of a failure of my right ot a speedy trial, the fact i had 2 lawyers and 2 diff court dates,
the place I was stopped was a boarder checkpoint and they had no cause to search through all my luggage and shit just to find a pipe, also i was looking at the papers and I noticed a complant was filed by a citizen, so I would assume that should of forced the police to pull me over, but they never did
also, i still dont believe I blew a .11 since I had dranken the night before and had gotten up and went to class and no one said wow you smell like a brewery,
only if i could talk to my lawyer and have him puruse it instead of just another

last night a drunk driver plowed through my neighborhood...literally.  Started by hitting a telephone poll, drove away from that, sounded like he was dragging his tire, then plowed into a parked car, pushing it into the car behind it, then tried to drive away from that, at which time the cops arrived and hauled his menace to society ass to jail.

My car was recently hit by a junkie with no insurance. Junkie is now in jail on unrelated matters and, since I don\'t have collision insurance (my car is too old to qualify), I\'m shit out of luck driving a car with a dented trunk that doesn\'t open, a rear door that doesn\'t open, a smashed tail light and a bumper that is in danger of falling off. Fuck the system.
