I hope he had insurance and it covers a rental and full maintenance for you. Nothing worse than getting hit by someone without, has happened to a few people I know.

Glad that no serious injury had occurred. Hope everything works out.

As for insurance in NY which I sell, the guy will be carrying at least 25000 in property damage if he has insurance.

Did you hit a car in front of you? or was it a 2 car accident?

He hit me so hard I hit the guy in front of me. So yes I did hit the guy in front of me

They both have Geico and they called me and said they would pay for all of it so I am assuming that means they are accepting liability but I have to follow up with my INS company to see if that is indeed the case

Good Luck Mike.  Insurance and people who sell insurance are the biggest scamming con artists out there....before you know it there\'s change missing from the dresser and your daughter\'s knocked up.  Believe me I have seen it happen millions of times......

So far so good. Progressive has been pretty good. I chose to handle it through my insurance and things seem to be going well. They are taking my car to the shop today and I should know how long it will take to fix by the end of the day

We are legal conartists because the law state that you need to provide financial responsibility to operate a motor vehicle legally.

You should be alright with the claim, Progressive will probably end up subrogating the money from GEICO but since 2 of the drivers are GEICO insured, its easier for GEICO to assume responsibility and pay the claim. Good luck.

i have heard that too, but wouldn\'t this be the 1/10 time that, because you were hit from behind thus being forced into someone else\'s behind, it wouldnt apply?

anytime you hit someone from behind its your fault regardless because most times your insurance company will pay out property damage because it is easier than subrogation. In this case GEICO has 2 insureds which is just easier to settle a claim in house then going and trying to get money from Progressive only to have Progressive get it back from GEICO.

An insurance carrier may reserve the "right of subrogation" in the event of a loss. This means that the company may choose to take action to recover the amount of a claim paid to a covered insured if the loss was caused by a third party. After expenses, the amount recovered must be divided proportionately with the insured to cover any deductible for which the insured was reponsible.

Basically Progressive pays Mike and then Progressive goes after GEICO to get the money back that they paid him.

wow...that totally sucks!  i hope you\'re alright, and at least you were able to walk away.  i know too many people who have died in car accidents (whether it was their fault or not).  i actually was in an accident with a dump truck and a school bus last year (not my car, i was just the passenger)..it was completely the fault of the dump truck driver...and then he tried scamming my friend by not giving her any insurance info!  people are TARDS and should not be on the road!  it irritates me so much that there are people out there that are driving and not paying attention...it\'s exactly like that Allstate commercial with ex-president Palmer (from 24), where they have the guy trying to change his pants while driving...the make-up artist...the guy eating cereal or whatever from a bowl...and then you have your drunk drivers which are the worst!...well, now that that\'s off my chest  :)  i hope you at least bitched out this person for slamming you.  good luck with the insurance bs.
